Terms of Service

These terms are an agreement between you and Shivah Web Tech Pvt. Ltd. ("we", "us"). Part A covers Shivah AI Marketing, our paid marketing service. Part B covers the private staff console our own employees use. By signing up for, paying for or using either, you accept the part that applies to you.

A1. The service

Shivah AI Marketing researches your business's website, Google profile and social media each month; writes and designs posts, captions and blog articles; publishes the ones you approve to the accounts you connect; watches your website's uptime; reports on your advertising accounts; and sends you a monthly report. What each plan includes — how many posts, articles and accounts — is shown on the plans page at the time you subscribe and in your dashboard.

A2. Your account

• You must be at least 18 and authorised to act for the business you sign up.
• Give accurate details and keep them up to date — invoices are issued in the name and GST number you give.
• Keep your password to yourself. You are responsible for what is done with your account.

A3. Plans, billing and GST

• Plans are billed monthly, in advance. Prices are shown before GST; GST (currently 18%) is added and shown on each invoice.
• Your first month starts when your first payment succeeds.
• Each next month's invoice and payment link is sent 3 days before your current month ends. Pay it and the service carries on.
• If a renewal is not paid, the service continues for 7 days after your month ends; after that, research, publishing and reports are paused until it is paid.
• Payments are taken by our payment providers (PayPal, Razorpay or Stripe) on their own pages; their terms apply to the payment itself.

A4. Changing plan and cancelling

• You can change plan or cancel at any time from your dashboard (Billing).
• A cancellation takes effect at the end of the month you have paid for. Until then everything carries on; after it, publishing stops and no further invoices are raised.
• A plan change applies from your next month.

A5. Refunds

Because each month's work starts as soon as it is paid for, payments are not refundable for part of a month or for a month already under way. If you were charged in error, or charged twice, tell us within 7 days and we will refund the charge in full. Nothing in this section limits a refund the law entitles you to.

A6. Approvals and your content

• Nothing is published until it is approved. When you approve a post or article, you are confirming it is accurate and that you are happy for it to appear under your business's name.
• You keep ownership of your brand, logos and material you give us. You give us permission to use them to provide the service.
• Content we create for you is yours once the month it was made for has been paid.
• You must have the right to everything you give us to use, and must not ask us to publish anything unlawful, misleading or that breaks the rules of the platform it is published on.

A7. Your connected accounts and advertising

• You connect your Facebook Page, Instagram, Google and advertising accounts yourself and can disconnect them at any time. What we do with each permission is set out in the privacy policy.
• Your use of those platforms remains subject to their own terms (Meta, Google and others). We are not responsible for their decisions, such as a post being removed or an account being restricted.
• Advertising spend is paid by you directly to the ad platform. We report on it and suggest changes; we do not run or pay for your ads unless separately agreed in writing.

A8. Results

We work to improve your visibility, but rankings, reach, followers, leads and sales depend on many things outside our control — search engines, platform algorithms, your market and your competitors. We do not guarantee any particular result. AI-written material can contain mistakes, which is why every item comes to you for approval first.

A9. Availability and changes

We aim to keep the service running continuously but cannot promise it will never be interrupted — for maintenance, or because a platform such as Meta or Google changes or limits its service. We may improve or change features; if a change materially reduces what your plan includes, we will tell you in advance and you may cancel.

A10. Suspension and termination

We may suspend or end an account that is used unlawfully, that asks us to publish unlawful content, or that breaks these terms, telling you why. If we end the service for reasons that are not your fault, we will refund any unused part of a paid month.

A11. Liability

To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of profit, business or data, and our total liability to you in any 12 months is limited to the fees you paid us in the three months before the event. Nothing here limits liability that cannot lawfully be limited.

B. The staff console

The staff console is a private tool for Shivah Web Tech Pvt. Ltd.'s own employees, contractors and trainees. Only people we issue an account to may use it. Accounts are personal and must not be shared. Use it only for the company's work; do not try to reach records your account has not been given, or to get round the permission system. Everything recorded in it belongs to Shivah Web Tech Pvt. Ltd., and access ends when the account does. It is provided as it is for internal use, and backups — including copies kept in Shivah Web Tech Pvt. Ltd.'s own Google Drive using the drive.file permission — are a safeguard, not a guarantee.

Changes to these terms

If these terms change, the date at the top of this page changes with them. We will email subscribers about any change that affects them before it takes effect; continuing to use the service after that means accepting it.

Governing law

These terms are governed by the laws of India. The courts at Sahibzada Ajit Singh Nagar (Mohali), Punjab have exclusive jurisdiction.
